Welcome to the Practice Hub terms
and conditions.
These terms and conditions, are
between Practice Hub and you, (hereinafter referred to as “You” or “Your” or
“User(s)”). By accessing our website [object Object] (“Website”) and/or our app
‘Practice Hub’ (“Apps”), Website and Apps together shall be referred to as “Practice
Hub Platform”, you agree to be bound by the provisions of these Terms and
Conditions.
Please read these Terms and
Conditions carefully, along with the Privacy Policy and all other rules and
policies made available or published on Practice Hub Platform as they shall
govern your use of the Practice Hub Platform. You signify your agreement to (1)
these “Terms and Conditions”, (2) Practice Hub’s Privacy Policy and any other
terms that are updated from time to time by using or visiting the Practice Hub
Platform and service provided to you on, from, or through the Practice Hub
Platform. If you do not agree to any of these terms, please do not use the Practice
Hub Platform.
1. About Practice Hub
The domain name, website and the
apps are registered, owned and operated by Curious Fauna & Co, a partnership
firm incorporated under the Indian Partnership Act, 1932, and having its
registered office at: H 1/5, FF, Krishna Nagar, Delhi-110051 (hereinafter
referred to as “Practice Hub” or “us” or “we” or “our” or “company” or “firm”
or “organization”).
2. Eligibility
By agreeing to these Terms of
Use, you represent that you are legally competent to enter into an agreement
and provide consent to these Terms of Use. You further represent that

3. Practice Hub
Platform
a) These Terms and Conditions
apply to all Users of the Practice Hub Platform. The Practice Hub Platform
includes all aspects of the Website and Apps which includes but is not limited
to products, software and service offered via the Practice Hub Platform any
other service or application that Practice Hub introduces from time to time.
b) Practice Hub Platform is an
online platform that supports and facilitates the online test series assessment
and other allied activities for aspiring students. It also acts as an
intermediary between the educator/employer and the student/job-seeker. Any
content uploaded through the use of the Practice Hub Platform shall hereinafter
be referred to as “User Content”. You agree and acknowledge that Practice Hub
has no control over and assumes no responsibility for, the User Content and you
expressly relieve Practice Hub from any and all liability arising from the User
Content by using the Practice Hub Platform.
c) The Practice Hub Platform may
include or contain links to any third-party websites that may or may not be
owned or controlled by us. Practice Hub assumes no responsibility for, the
content, privacy policies, or practices of any third-party websites. You
expressly relieve Practice Hub from any and all liability arising from your use
of any third-party website or services by using the Practice Hub Platform.
However, it is recommended that you read and understand the terms and
conditions and privacy policy of each such website that you visit before you
use any third-party services or website.
d) Subject to these Terms and
Conditions, Privacy Policy and all other rules and policies made available or
published elsewhere, Practice Hub hereby grants you a non-exclusive,
non-transferable, non-sub licensable, limited license to use the Practice Hub
Platform in accordance with these Terms and Conditions.
e) Practice Hub shall have the
right to change or discontinue any aspect or feature of the Practice Hub
Platform, including, but not limited to, the User Content, hours of
availability and equipment needed for access or use.
f) Further, Practice Hub may discontinue
disseminating any portion of information or category of information may change
or eliminate any transmission method and may change transmission speeds or
other signal characteristics. Practice Hub reserves the right to refuse access
to the Practice Hub Platform, terminate Accounts, remove or edit contents
without any notice to you.
4. Practice Hub
Accounts
a) The user has to create the
user account with Practice Hub platform In order to access the available
services and features of the Practice Hub Platform.
b) You confirm that you will
intentionally or unintentionally never use another User’s account nor provide
access to your account to any third-party.
c) You confirm that the
information provided for the registration on Practice Hub Platform is accurate
and complete while creating your account. Further, you agree that you are
solely responsible for the activities that occur on your account, and you shall
keep your account password secure and not share the same with anyone.
d) You confirm that you must
notify Practice Hub immediately of any breach of security or unauthorized use
of your account. At no point in time will Practice Hub be liable for any losses
caused by any unauthorized access/use of your user account; you shall solely be
liable for the losses caused to Practice Hub or others due to such unauthorized
use, if any.
e) Practice Hub takes no responsibility
for any User Content that is uploaded on the Practice Hub Platform, and
further, the User shall be solely responsible for his or her own actions in
utilizing such User Content and availing the Practice Hub Platform provided
herein.
5. Access, Permissions
and Restrictions
Practice Hub hereby grants you
permission to access and use the Practice Hub Platform as set forth in these
Terms and Conditions provided that you confirm that you:
a) Not to distribute in any
medium any part of the Practice Hub Platform or the content without Practice
Hub’s prior written authorization.
b) Not to alter or modify any
part of the Practice Hub Platform.
c) Not to use the Practice Hub
Platform for any commercial uses unless you obtain Practice Hub’s prior written
approval.
d) not to use or launch any
automated system, including without limitation, “robots,” “spiders,” or
“offline readers,” that accesses the Practice Hub Platform in a manner that
sends more request messages to Practice Hub’s servers in a given period of time
than a human can reasonably produce in the same period by using a conventional
on-line web browser.
e) Not to solicit, for commercial
purposes, any Users of the Practice Hub Platform with respect to User Content.
f) Receive updates and installs
from time to time from Practice Hub. These updates are designed to improve,
enhance and further develop the Practice Hub Platform and may take the form of
bug fixes, enhanced functions, new software modules and completely new
versions. You agree to receive such updates (and permit Practice Hub to deliver
these to you) as part of your use of the Practice Hub Platform.
g) May post reviews, comments and
other content; send other communications; and submit suggestions, ideas,
comments, questions or other information as long as the content is not illegal,
obscene, threatening, defamatory, invasive of privacy, infringement of intellectual
property rights, or otherwise injurious to third parties or objectionable and
does not consist of or contain software viruses, political campaigning,
commercial solicitation, chain letters, mass mailings or any other form of
spam. Further, you give Practice Hub royalty free, worldwide, non-exclusive
license to use the User Content and communication in developing its Practice
Hub Platform and in any of its marketing or promotional activities.
h) Comply with all applicable
laws and regulations in your use of the Practice Hub Platform.
i) Practice Hub reserves the
right to discontinue any aspect of the Practice Hub Platform at any time with
or without notice at its sole discretion.
6. Content Use
In addition to the general
restrictions mentioned above, the following limitation and conditions shall
apply to your use of the Content.
a) Practice Hub Content utilized
on the Practice Hub Platform which shall include but not be limited to
trademarks, service marks and logos (“Marks”), process, images, software,
graphics are owned by or licensed to Practice Hub and subject to copyright and
other intellectual property rights under the law.
b) User Content is provided to
you on an AS IS basis. You may access Content for your information and personal
use solely as intended through the provided functionality on the Practice Hub
Platform and as permitted under these Terms and Conditions.
c) You shall not download any
User Content unless you see a “download” or similar link displayed by Practice
Hub on the Practice Hub Platform for that User Content.
d) You shall not copy, reproduce, make available
online or electronically transmit, publish, adapt, distribute, transmit,
broadcast, display, sell, license, or otherwise exploit any User Content for
any other purposes other than as provided herein without the prior written
consent of Practice Hub or the respective licensors of the User Content. Practice
Hub and its licensors reserve all rights not expressly granted in and to the Practice
Hub Platform and the User Content.
e) You confirm not to circumvent,
disable or otherwise interfere with security-related features of the Practice
Hub Platform or features that prevent or restrict use or copying of any User
Content or enforce limitations on use of the Practice Hub Platform or the User
Content therein.
f) You acknowledge that you may
be exposed to User Content that is inaccurate, offensive, indecent, or
objectionable, and you agree to waive, and hereby do waive, any legal or
equitable rights or remedies you have or may have against Practice Hub with
respect thereto, and, to the extent permitted by applicable law, agree to
indemnify and hold harmless Practice Hub, its owners, operators, affiliates,
licensors, and licensees to the fullest extent allowed by law regarding all matters
related to your use of the Practice Hub Platform.
7. Content and Conduct
a) As a Practice Hub User, you
may submit User Content on the Practice Hub Platform, including videos and User
comments. You understand that Practice Hub does not guarantee any
confidentiality with respect to any User Content you submit.
b) You shall be solely
responsible for your own User Content and the consequences of submitting and
publishing such User Content on the Practice Hub Platform.
c) You affirm, represent, and
warrant that you own or have the necessary licenses, rights, consents, and
permissions to publish the User Content that you submit; and you grant limited
license to Practice Hub to all patent, trademark, trade secret, copyright or
other proprietary rights in and to such User Content for publication on the Practice
Hub Platform pursuant to these Terms and Conditions for the duration the said
User Content is available on Practice Hub Platform.
d) You further agree that User
Content you submit on the Practice Hub Platform will not contain third party
copyrighted material, or material that is subject to other third party
proprietary rights, unless you have permission from the rightful owner of the
material or you are otherwise legally entitled to post the material and to
grant Practice Hub all of the license rights granted herein.
e) For clarity, you retain your
ownership rights in your User Content however, by submitting User Content to Practice
Hub, you hereby grant Practice Hub a limited, worldwide, non-exclusive,
royalty-free, sub-licensable and transferable license to use, reproduce,
distribute, display, publish, make available online or electronically transmit,
the User Content in connection with the Practice Hub Platform and Practice Hub’s
(and its successors’ and affiliates’) business, including without limitation
for promoting and redistributing part or all of the Practice Hub Platform in
any media formats and through any media channels.
f) You also hereby grant each
User of the Practice Hub Platform a limited, non-exclusive license to access
your User Content through the Practice Hub Platform. The above licenses granted
by you in the User Content you submit to the Practice Hub Platform terminate
within a commercially reasonable time after you request Practice Hub to remove
or delete your videos from the Practice Hub Platform provided you pay the
mutually agreed amount that Practice Hub incurred in providing the Practice Hub
Platform to you. You understand and agree, however, that Practice Hub may
retain, but not display, distribute, or perform, server copies of your videos
that have been removed or deleted. The above licenses granted by you in User
comments and testimonial you submit are perpetual and irrevocable.
g) Furthermore, you confirm that to
the best of your knowledge, the User Content uploaded by you is not false,
inaccurate or misleading; infringe any third party’s copyright, patent,
trademark, trade secret or other proprietary rights or rights of publicity or
privacy; Violate any law, statue, ordinance or regulation; defamatory,
unlawfully threatening or unlawfully harassing; obscene or contain pornography.
Contain any viruses, Trojan horses, worms, cancelbots or other computer
programming routines that may damage, detrimentally interfere with,
surreptitiously intercept or expropriate any system, data or personal
information.
h) If at any given point it comes
to the notice of Practice Hub that you are engaged in any kind of harassment of
other Users, then in such a case you agree that Practice Hub shall have the
sole right to suspend/terminate your account with immediate effect and without
any notice of such suspension or termination and we also reserve the right in
our sole discretion to initiate any legal proceedings against you in such
cases.
i) Practice Hub will remove all
User Content if properly notified that such Content infringes on another’s
intellectual property rights. Practice Hub reserves the right to remove User
Content without prior notice if it has reason to believe that the User Content
infringes any copyright.
8. Course Listings
Practice Hub platform will
contain listing of various online Courses including, but not limited to, the
subject, topic, number of sessions, mode of conduct, and time slots of the
lectures and pricing and related rules and financial terms will be listed on
the Site and the Application. You understand and agree that the placement or
ranking of Listings in search results may depend on a variety of factors,
including, but not limited to users preferences, ratings.
9. Guidelines for Practice
Hub Pro Members
If you are a user of Practice Hub
Pro app, you understand and agree that your relationship with Practice Hub is
limited to being a Member and an independent, third-party contractor, and not
an employee, agent, joint- venturer or
partner of Practice Hub for any reason, unless specifically provided in a
written contract with such user and that too for the mentioned period as per
the written contract. Practice Hub is not liable for your offline activities.
As a Member you agree not to do anything to create a false impression that you
are endorsed by, partnering with, or acting on behalf of or for the benefit of Practice
Hub, including by inappropriately using any Practice Hub intellectual property.
10. Payment and Refunds
Practice Hub offers you multiple
payment methods and these payment gateway partners use secure encryption
technology to keep the payee details confidential.
A subscription fee on Practice
Hub Platform is refundable subject to applicable refundable policy at the time
of subscription.
11. Disclaimer of
Warranty
WE (INCLUDES PRACTICE HUB AND ITS
AFFILIATES) HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR
IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES
OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE. THE
COMPANY WILL NOT BE LIABLE FOR ANY LOSSES, DAMAGES OR CLAIMS BY YOU OR ANY
THIRD-PARTY IN THIS REGARD. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH
CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
12. Force Majeure
Practice Hub shall not be liable
for failure to perform, or the delay in performance of, any of its obligations
if, and to the extent that, such failure or delay is caused by events
substantially beyond the its control, including but not limited to acts of God,
acts of the public enemy or governmental body in its sovereign or contractual
capacity, war, terrorism, floods, fire, strikes, epidemics, civil unrest or riots,
power outage, and/or unusually severe weather.
We do not guarantee continuous,
uninterrupted or secure access to the Practice Hub Platform, and operation of
the Practice Hub Platform may be interfered by numerous factors outside our
control.
13. Copyright
Infringement
Practice Hub respects the
copyright laws and therefore, if you believe in good faith that your copyright
has been infringed, you may provide us with a written detailed information
